Why foreclosure in Texas moves faster than people expect

Most people assume they have months. In Texas that assumption is often wrong, and by the time the maths is clear the window has narrowed considerably.

Texas is one of the fastest foreclosure states in the country

Most Texas mortgages are foreclosed non-judicially, which means no court case and no judge — the process runs on notices and deadlines set out in your deed of trust. You typically receive a notice of default giving you a period to bring the loan current, and then a notice of sale at least 21 days before the auction. Foreclosure sales are held on the first Tuesday of the month at the county courthouse. From falling behind to losing the house can take far less time than in most states.

The bank will not pause while you list it

A traditional sale takes 30 to 60 days at best once a buyer is found, and that is before their lender has finished underwriting. Listing usually cannot outrun a sale date that has already been posted.

There may be little or no equity to work with

If the loan balance, arrears and fees are close to what the house is worth, a retail sale with a six percent commission can leave nothing at all — and you cannot pay a commission out of money that is not there.

Forbearance — a temporary pause or reduction, useful where the hardship is short term, like an illness or a job loss you expect to recover from. Selling — including to a buyer like us. This makes sense when the other routes are not available, when there is equity worth protecting, or when you want the matter finished on your own terms rather than the lender’s. Often yes. We have bought homes with an auction date already posted. What matters is how much time remains and whether title can be cleared before then, which is why calling early makes such a difference. Once the sale has actually happened the house is generally gone — Texas does not give homeowners a right to buy it back after a standard mortgage foreclosure.
Still worth a conversation. We buy where equity is thin or absent, and in some cases a lender will agree to accept less than the full balance. We will look at the numbers honestly and tell you what we see rather than encouraging you either way.
