Why an occupied rental is hard to sell on the open market

Selling a rental is not the same transaction as selling a home you live in, and the difference catches most landlords out at exactly the wrong moment.

The lease does not end because you sell

In Texas a sale does not cancel an existing tenancy. The buyer takes the property subject to the lease already in place, inherits the tenant, and generally becomes responsible for the deposit. That rules out most retail buyers immediately, because the majority are buying a house to live in themselves.

Getting possession first takes time and money

Emptying the property before selling means a notice to vacate, a filing in the Justice of the Peace court if the tenant does not go, a hearing, and possibly a writ of possession. That is weeks at best, plus filing fees and often a lawyer — all spent before you have earned anything.

Showings are difficult when someone else lives there

A tenant who did not choose to have the property sold has little reason to keep it presentable or to accommodate viewings. Access becomes a negotiation, and a property that shows badly sells slowly and for less.

Maintenance on a rental tends to be deferred until it becomes urgent, and turnover costs get postponed year after year. By the time you decide to exit, the list is long enough that a buyer's lender is likely to object to it.

The tax bill is larger than most landlords expect

Selling a rental is not treated like selling your own home. The depreciation you have claimed over the years is generally recaptured and taxed when you sell, on top of any capital gain, and the exclusion that protects a primary residence does not apply. It surprises people who had only budgeted for capital gains.

Questions landlords ask before selling

Yes, and we do it regularly. The tenancy carries over to us and the tenant stays. You do not need to give notice, wait out the lease or evict anyone before selling.
No. In fact we would usually rather you did not, because it costs you weeks and money for no benefit. If the tenant is already being evicted, or the property is empty after one, that is fine too.
Deposits are handled at closing, typically credited to us as the incoming owner along with responsibility for returning them. The title company documents it so nobody is left uncertain.
It does not stop us buying. Arrears owed to you up to the closing date remain a matter between you and the tenant; we start fresh from the date we take over.
Manageable. We can often assess from the exterior, previous photographs and your own knowledge of the property. Access is not a condition of us making an offer.
Possibly. Selling a rental usually triggers tax on the depreciation you have claimed over the years, in addition to any capital gain, and the exclusion that protects a primary residence does not apply to an investment property. A 1031 exchange can defer it if you are rolling into another investment. This one genuinely needs a CPA before you commit to anything.
